Terms and Conditions
Considering that Monarch Wear provides a distribution channel for new products from foreign partners ("Marketplace");
Taking into account the customer's interest in purchasing products offered by Monarch Wear ("Products") and Marketplace partners ("Partners") through their online sales channels;
The purpose of this agreement is to establish the general terms and conditions for the use and purchase of products by the customer on the Monarch Wear website (https://monarchwear.uk/).
Privacy:
1.1. Monarch Wear is responsible for ensuring the confidentiality of all data and information provided by the customer during the purchasing process.
1.2. The customer agrees not to disclose their website passwords to third parties and to take appropriate measures to maintain the confidentiality of their information. If the customer becomes aware and/or suspects that third parties have accessed their passwords, they agree to inform Monarch Wear so that the necessary measures can be taken.
1.3. By completing the registration process, the customer declares that the information provided about them is correct, truthful, and complete, and understands that providing false information may result in both criminal and civil liability under Brazilian law.
1.4. The customer explicitly consents to Monarch Wear sharing their personal data and information with other companies within the corporate group, Xiaomi subsidiaries, and authorities, as far as necessary for the purchasing process and compliance with applicable laws.
1.5. Your data will also be shared with the return agent as necessary to process international product returns through the website in accordance with applicable laws.
Customer Service (SAC):
2.1. The customer can use this service to clarify questions, make requests, or file complaints regarding their order or the content on the website. The SAC can be contacted by phone, via the form on the website, or by email at uk.monarchwear@gmail.com, all of which are accessible in our "Help Center."
Shipping Conditions:
3.1. The delivery time for the products will be communicated during the purchasing process and is calculated in business days. Deliveries are made from Monday to Friday between 08:00 and 22:00. In some cases, deliveries may also occur on Saturdays, Sundays, and holidays.
3.2. It is the customer's responsibility to verify the product's dimensions. The customer must ensure that these fit within the spatial boundaries of the elevator, doors, and hallways at the delivery location. No assembly or disassembly of the product, transportation via stairs, doors, windows, or lifting of the delivery will be performed.
3.3. A maximum of three delivery attempts will be made on different days to the specified address, with a maximum interval of 48 hours between each delivery. It is important that an authorized person over the age of 18, who can present identification, is present at the delivery address to receive the goods and sign the delivery protocol. After three failed delivery attempts, the order will be returned to Monarch Wear's distribution center.
3.4. After completing the order, it is no longer possible to change the payment method and/or delivery address or request expedited or priority shipping.
3.5. The delivery time indicated during the purchasing process takes into account stock availability, region, billing process, and product preparation time. For each status update of the order delivery, Monarch Wear's system will automatically send email notifications to the customer.
3.6. The shipping costs for delivery are based on various factors, such as the delivery location, the product's weight, and dimensions.
3.7. Monarch Wear does not allow the shipping service provider to:

Enter the house;

Deliver by alternative means (e.g., handing the product through a window);

Install or maintain products;

Open the product's packaging;

Deliver to an address other than the one specified in the DANFE (Document Attachment of the electronic invoice) and/or the invoice;

Deliver to minors or persons without identification documents.
3.8. Monarch Wear is not responsible for the storage of goods at the tax authorities (SEFAZ), should this only occur due to open issues of the customer and the customer must be present with the tax authorities to release the goods. In this case, the information about the release and payments will only be shared with the involved parties.
3.9. The rules in points 3.1 to 3.8 also apply to products sold and delivered by Marketplace Partners.
3.10. For the purposes of this agreement, the customer is considered the importer of the product and is fully responsible for the international purchase, with Monarch Wear only providing its platform to mediate and manage the transaction.
3.11. The customer acknowledges that the international partner is fully responsible for the products available on their websites, their respective features, and timely delivery in accordance with Brazilian international trade legislation and other applicable laws.
3.12. By purchasing, the customer is subject to the terms and regulations set out in our Shipping and Delivery Policy.
Right of Withdrawal:
4.1. The customer has the right to cancel their purchase and return the product. In this case, the following conditions must be met:

The withdrawal period for the product purchase is 7 (seven) calendar days from the receipt date;

The product must be returned to Monarch Wear, preferably in its original packaging or the packaging it was delivered in. It is important that the DANFE (Document Attachment of the electronic invoice) or the invoice, as well as all accessories provided with the purchase, are included.

For returns of fashion products, CDs, and DVDs, the product label or seal is also required.
Return and Exchange Conditions:
5.1. All incidents regarding returns or exchanges will be handled in accordance with applicable Brazilian legislation.
5.2. The purchase of a product on the Monarch Wear website is eligible for returns due to manufacturing defects within 7 (seven) days of receipt and for exchanges if the product size is unsuitable, within the same period and under the same conditions.
General Provisions:
6.1. Monarch Wear reserves the right to change the terms and conditions of the website at any time without prior notice, as well as the right to change prices, shipping costs, and delivery times for products.
6.2. In the event of a dispute, the competent court is the court at the customer's place of residence.
